Terms and conditions
This Rental Agreement is made between Martin Dumpster Rentals and any customer who utilizes our dumpsters or related services. By renting a container, the customer agrees to the terms outlined below.
Equipment And Rental Term
Martin Dumpster Rentals will deliver a dumpster (“Container”) of the agreed size to the address provided by the customer. The standard rental term is seven (7) days from the date of drop-off. Extensions can be arranged prior to pickup and may include additional daily charges. Delivery and pickup will be scheduled in advance. If access issues or unsafe conditions prevent service, additional days or trip-charges may apply.
Delivery and placement
Customers must provide a safe, accessible area for dumpster placement (driveway, private property, etc.). If placement is on public property or requires a permit, it is the customer’s responsibility to obtain that permit unless otherwise arranged. Only Martin Dumpster Rentals is authorized to move or remove the dumpster. The company is not liable for damage to driveways, lawns, curbs, septic systems, or underground utilities unless caused by gross negligence.
Usage, Prohibited Materials and Weight Limits
Dumpsters are for general waste, yard debris, and construction materials. Prohibited items include: hazardous waste, paint, chemicals, oils, tires (unless pre-approved), electronics, appliances (unless arranged), liquids, medical waste, and explosives. Dumpsters must not be filled above the rim or exceed the weight limit. Overfilled or overweight containers may result in additional fees or delayed pickup. If prohibited materials are found or the dumpster is overloaded, pickup may be refused until the issue is corrected. Customers remain responsible for related charges. If your load exceeds the included weight limit, an additional charge of $80 per ton (or the disposal site’s current rate, whichever is higher) will apply. The maximum weight allowed is three tons. Loads that go over this limit will incur a $150 base fee, plus $100 per hour for any time required by Martin Dumpster Rentals (MDR) to remove the excess material. Customers will be contacted before unloading and may choose to remove the extra weight themselves. Tire disposal costs a minimum of $20 per tire unless other arrangements are made in advance, and all tires must be off the rim. Shingles can be accepted with prior approval from MDR. Once approved, shingles, tar paper, and nails may be placed in the dumpster. A minimum $85 fee applies if shingles are mixed with other debris types.
Fees, Payment and Additional Charges
The rental fee includes standard delivery, pickup, and the initial rental term. Payment is due at the time of booking. Accepted forms include credit or debit cards. Additional fees may apply for extra rental days, weight overages beyond the included allowance, trip or dry-run charges if the dumpster is blocked or inaccessible, special disposal or handling of restricted materials, and street placement or permit costs. Customers authorize Martin Dumpster Rentals to charge their card on file for any applicable additional fees.
Responsibility, Access and Inspection
Customers are responsible for keeping the dumpster accessible and preventing unauthorized dumping. If the dumpster cannot be accessed for pickup (blocked vehicles, snow, locked gates, etc.), additional charges may apply. Inspect the dumpster upon delivery and report any visible damage before use. After delivery, customers assume responsibility for loss or damage (excluding normal wear and tear).
Termination and Removal
Martin Dumpster Rentals may remove the dumpster at any time if the customer violates this agreement or if safety or access concerns arise. Early pickup may be requested, but no refund or credit will be issued for unused days.
Indemnification and Limitation of Liability
Customers agree to indemnify and hold harmless Martin Dumpster Rentals, its employees, and contractors from any claims, damages, or liabilities arising from misuse, prohibited materials, or improper placement. The company’s liability shall not exceed the total amount paid for the rental. Martin Dumpster Rentals is not liable for indirect or consequential damages. While we do our best to prevent any damage, we cannot guarantee that none will occur. We provide protective boards or plywood to place underneath where the front and rear rollers of the dumpster will be positioned. Even with this precaution, in extreme weather, the weight of a full dumpster can sink into the pavement.
Force Majeure
Neither party is liable for delays or inability to perform caused by weather, road closures, labor disputes, equipment failure, or other events beyond reasonable control.
Governing Law and Severability
This Agreement is governed by the laws of the State of Wisconsin. If any part of this Agreement is found invalid, the remaining provisions remain in effect.
Entire Agreement
This Agreement represents the full understanding between Martin Dumpster Rentals and the customer. No modifications are valid unless in writing and agreed to by both parties.
